This website (“Service”) is operated by YAVORSKA LIMITED LIABILITY COMPANY, ul. Władysława Syrokomli 3, 80-267 Gdańsk, Poland, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under KRS number: 0000421633, VAT ID (NIP): PL5842727188, REGON: 221751726 (“Administrator”).

This Privacy Policy defines the principles for storing and accessing information on the User’s device using cookies, which enable the provision of electronic services by the Administrator, as well as the rules for using Web Push notifications through the Service.

Please read these terms carefully before using the Service. By using the Service, you confirm that you accept these terms regardless of whether you choose to register on the Administrator’s website.

Users may change their cookie settings in their web browsers, e.g. they can partially restrict or completely disable the storage of cookies. If no changes are made in this regard, cookies will be stored on the User’s device. Changing cookie settings may limit the functionality of the Service (for example, in an online store it may be impossible to complete the order process because products will not be remembered in the cart during subsequent steps).

§ 1. Definitions

Administrator – means YAVORSKA LIMITED LIABILITY COMPANY, ul. Władysława Syrokomli 3, 80-267 Gdańsk, Poland, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under KRS number 0000421633, VAT ID PL5842727188, REGON 221751726, which provides electronic services, stores and accesses information on the User’s devices, processes personal data obtained via the Service, and sends Web Push notifications through the Service.

Cookies – means IT data, in particular small text files, stored and saved on devices through which the User accesses the Service.

Administrator’s Cookies – means cookies placed by the Administrator in connection with providing electronic services through the Service.

External Cookies – means cookies placed by partners of the Administrator via the Service’s website.

Web Push Notifications – means messages containing marketing information, including current promotions available in the Service, sent by the Service to the User’s web browser. Web Push notifications are sent to the User’s web browser only after obtaining the User’s consent for such communication.

Service – means the website or application operated by the Administrator, available at: https://yavorska.co/

Device – means an electronic device through which the User gains access to the Service.

User – means an individual or entity for whom, under the Terms of Service and applicable law, electronic services may be provided, or with whom an agreement for the provision of electronic services may be concluded.

§ 2. Types of Cookies Used

The cookies used by the Administrator are safe for the User’s Device. In particular, they do not allow viruses or other unwanted or malicious software to enter the User’s Device. These files allow the identification of the software used by the User and the customization of the Service for each individual User. Cookies typically contain the domain name from which they originate, the duration of storage on the Device, and a specific value.

The Administrator uses two types of cookies:

a) Session cookies: these are stored on the User’s Device and remain there until the end of the web browser session. The stored information is then permanently deleted from the Device. The mechanism of session cookies does not allow the retrieval of any personal data or confidential information from the User’s Device;

b) Persistent cookies: these are stored on the User’s Device and remain there until deleted. Ending the browser session or turning off the Device does not remove them. The mechanism of persistent cookies does not allow the retrieval of any personal data or confidential information from the User’s Device.

The User may restrict or disable cookies on their Device. If this option is used, the Service may still be accessible, except for features that require cookies by their nature.

§ 3. Purposes of Using Cookies

The Administrator uses its own cookies for the following purposes:

a) Service configuration – adapting the content of the Service’s web pages to the User’s preferences and optimizing the use of the Service;

b) analysis, research, and audience auditing – collecting general and anonymous statistical data, creating anonymous statistics through analytical tools that help understand how Users interact with the Service, allowing for improvements in structure and content;

c) advertising services – displaying advertising messages tailored to the User’s preferences.

The Administrator also uses external cookies for the following purposes:

a) Service configuration – adapting the content of the Service’s web pages to the User’s preferences and optimizing its use (administrator: Logic Progress);

b) analysis, research, and audience auditing – collecting general and anonymous statistical data via analytical tools such as Google Analytics (administrator: Google Inc., USA), HotJar (HotJar Ltd.), and Synerise (Synerise S.A.);

c) advertising services – displaying advertising messages tailored to the User’s preferences using analytical tools such as Google Ads (administrator: Google Inc., USA), RTB S.A. (Warsaw), and Cube Group S.A. (Warsaw).

§ 4. Managing Cookies

The User may change cookie settings at any time, determining the conditions for storing or accessing cookies on their Device. These settings may be changed in the web browser settings or via the configuration of the Service. In particular, the settings may be changed to block the automatic handling of cookies or to notify the User each time cookies are placed on their Device. Detailed information on cookie management is available in the browser’s settings.

The User may delete cookies at any time using the relevant browser features.

Restricting the use of cookies may affect certain functionalities available on the Service’s website.

§ 5. Web Push Notifications

1. Web Push notifications are sent to the User’s web browser only after the User has consented to receiving them. To give consent, the User must select the “allow notifications” option (or similar wording, depending on the browser) in the prompt displayed by their browser.

2. The User may withdraw consent to receive Web Push notifications at any time by changing their browser settings.

3. The Administrator does not process any personal data of Users using Web Push notifications. Users are identified only based on information stored in their web browsers, to which the Administrator has no access.

§ 6. Processing and Protection of Personal Data

1. The Administrator is the controller of the User’s personal data.

2. The Administrator makes every effort to respect the privacy and ensure the security of the User’s personal data obtained through the Service.

3. The Administrator, as the controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – “GDPR”), is responsible for all personal data provided by the User or obtained via the Service.

4. Personal data is processed in accordance with the GDPR, the Polish Data Protection Act, the Act on the Provision of Electronic Services, and Telecommunications Law.

5. Personal data of Users will be processed for purposes related to the use of the Service, for the legitimate interests pursued by the Administrator, and based on the User’s consent – for purposes consistent with the content of such consent (e.g., commercial, marketing, and newsletter purposes).

6. The data will be processed under Article 6(1)(a), (b), and (f) of the GDPR.

7. Providing personal data by the User is voluntary but necessary to use certain functionalities of the Service. Failure to provide data may prevent access to some features.

8. Personal data is processed based on the consent of the data subject.

9. The User has the right to request access to their personal data, rectification, erasure, or restriction of processing.

10. The User has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

11. Personal data will be stored until the User withdraws consent, and in the case of data processed for the legitimate purposes of the Administrator, for the period required by law.

12. The User has the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) if they believe that the processing of their personal data violates the law.

13. The User’s personal data may be processed for analytical, sales, and marketing profiling purposes, to tailor materials sent by the Administrator to the User’s needs and interests and to measure the effectiveness of services. No automated decisions will be made based on this profiling.
